AI Compliance & Acceptable Use Policy

1. Introduction

This AI Compliance & Acceptable Use Policy governs your use of VuraOS’s AI Telephony features, including the Inbound AI Receptionist, Auto-SMS Follow-ups, and Outbound capabilities. By using these features, you agree to comply with all applicable laws and accept full responsibility for your system configurations and campaigns.

VuraOS provides the technical infrastructure only. You are solely responsible for legal compliance, including obtaining valid consent for recording calls and sending automated messages.

2. Scope of the Policy

This policy applies to all inbound and outbound AI calls, automated SMS texts, voice cloning, and campaign features. It supplements our Terms of Service and Privacy Policy.

3. Inbound Call Recording & AI Disclosure

When utilizing the VuraOS Inbound Agent to intercept your missed calls, you must adhere to call recording and disclosure laws:

• Consent to Record: Many jurisdictions (such as California, Florida, and Germany) require "Two-Party Consent," meaning all parties on a call must be informed that the call is being recorded or transcribed. You must ensure your AI's greeting notifies callers (e.g., "Please note this call is recorded for quality purposes").
• AI Identification: Where legally mandated, the AI must explicitly identify itself as an artificial intelligence or virtual assistant to the caller at the beginning of the conversation.

4. Auto-SMS & Telecommunications Compliance

If you utilize the Auto-SMS Follow-Up feature to automatically text callers, you agree to strict compliance standards regarding Application-to-Person (A2P) messaging:

• You must not send SMS messages to individuals who have explicitly requested not to be contacted.
• Messages must not contain prohibited content (SHAFT: Sex, Hate speech, Alcohol, Firearms, or Tobacco), nor any deceptive or fraudulent links.
• Recipients must always have the ability to opt out (e.g., by replying "STOP").

5. Outbound Responsibilities & Consent

Should you utilize any outbound calling features, you must ensure that for every single phone number you call:

• You have obtained prior explicit consent (Germany/EU: § 7 UWG + GDPR; USA: TCPA “prior express written consent”).
• The number is not listed on the Robinsonliste (Germany), National DNC Registry (USA), or any equivalent local registry.
• You are not conducting cold-call telemarketing spam without verified opt-in records.

6. Prohibited Uses

You may not use VuraOS for:

• Cold calling or automated texting without valid prior consent.
• Routing or handling emergency calls (911, 112, 110, etc.).
• Spam, harassment, debt collection, or illegal activities.
• Any regulated industry (healthcare, finance, insurance) without configuring proper legal compliance and obtaining explicit consent from callers.
• Impersonating a real human without disclosing the AI nature where legally required.

7. International Compliance

You are responsible for compliance in every country you operate in or route calls to, including:

• Germany & EU: UWG, TKG, GDPR, Robinsonliste
• USA: TCPA, FCC rules, DNC Registry, A2P 10DLC regulations
• UK: PECR
• Singapore: PDPA

8. Indemnification

You agree to indemnify, defend, and hold harmless VuraOS, its owners, and operators from any claims, fines, lawsuits, or damages arising from your use of the telephony and AI features.

9. Enforcement & Termination

VuraOS may suspend or terminate your account immediately for any violation of this policy. No refunds will be issued in case of violation.

10. Changes to this Policy

We may update this policy at any time. Continued use of the platform constitutes acceptance of the updated policy.

11. AI Performance & Hallucination Disclaimer

The AI Twin is a probabilistic tool only. VuraOS makes no representation or warranty regarding the accuracy, completeness, or reliability of any AI-generated speech or response.

You are solely responsible for all content generated by the AI, the wording of your SMS templates, and for verifying every piece of information before acting on it. VuraOS shall not be liable for any damages, lost deals, client complaints, or claims arising from AI hallucinations, misunderstandings, or incorrect statements.
